1. Acceptance of Terms

By accessing, registering, or using the FEDSA Dance Sport Registration System ("the System"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the System.

These Terms constitute a legally binding agreement between you and the Federation of Dance Sport South Africa (FEDSA).

2. User Responsibilities

Account Security


  • Password Confidentiality: You are responsible for maintaining the confidentiality of your password

  • Account Usage: You are responsible for all activities that occur under your account

  • Notification: Notify us immediately of any unauthorised use of your account

  • Device Security: Ensure devices used to access the System are secure
  • Accurate Information


  • Truthful Information: You must provide accurate, current, and complete information

  • Updates: Keep your information updated and accurate

  • Verification: You may be required to verify your identity

  • False Information: Providing false information may result in account suspension
  • Compliance with Laws


    Users must comply with all applicable laws and regulations, including:
  • • South African law

  • • POPIA (Protection of Personal Information Act)

  • • Financial intelligence laws (FICA)

  • • Anti-money laundering regulations

    3. Payment Obligations

    Payment Terms


  • Full Payment: All entry fees and charges must be paid in full before competition

  • Payment Deadlines: Adhere to payment deadlines specified for each competition

  • Late Payments: Late payments may incur penalties or result in entry cancellation

  • Payment Methods: Accept payment methods are EFT, Paystack, and Cash (with approval)
  • Invoice Terms


  • Payment Due: Invoices are due upon receipt

  • Late Fees: Late payments may incur interest at 2% per month

  • Debt Collection: Unpaid invoices may be referred to debt collection agencies

  • Legal Costs: All legal costs for debt collection will be charged to the debtor

    4. Intellectual Property

    FEDSA Property


    The System and its content, including but not limited to:
  • • Software, databases, and technology

  • • Text, graphics, logos, and images

  • • Designs, layouts, and interfaces

  • • Trade marks and trade names
  • are owned by FEDSA and protected by South African and international intellectual property laws.

    User License


    FEDSA grants you a limited, non-exclusive, non-transferable license to:
  • • Access and use the System for personal or business purposes

  • • View and print content for your own use

  • • Submit information and entries through the System
  • Restrictions


    You may not:
  • • Copy, modify, or distribute the System

  • • Reverse engineer or attempt to extract source code

  • • Use the System for unlawful purposes

  • • Remove or alter copyright notices

  • • Use automated bots or scrapers
  • User Content


    By submitting content to the System (e.g., dancer profiles, entries), you grant FEDSA a:
  • Non-exclusive License: To use, display, and distribute your content

  • Modification Rights: To modify format or presentation

  • Perpetual License: For the duration of the content's relevance
  • You retain ownership of your content but grant these licenses for System functionality.

    5. Data and Privacy

    Data Collection


    FEDSA collects and processes personal information in accordance with POPIA. See our Privacy Policy for details.

    Data Usage


    Your data may be used for:

  • • Payment processing and invoicing

  • Retention: Data is retained for legal and business purposes

  • Rights: You have rights to access, correct, or delete your data

    6. Limitation of Liability

    System Availability


    The System is provided "as is" without warranties of any kind. FEDSA does not guarantee:
  • • Uninterrupted or error-free operation

  • • Correction of all defects or errors

  • • Freedom from viruses or harmful components

  • • Compatibility with all devices or browsers
  • Damages Exclusion


    To the maximum extent permitted by law, FEDSA shall not be liable for:
  • Indirect Damages: Including lost profits, data, or business opportunities

  • Consequential Damages: Arising from use or inability to use the System

  • System Downtime: For any losses due to System unavailability

  • Third-Party Actions: For actions of other users or third parties
  • Liability Cap


    FEDSA's total liability for any claim is limited to the amount you paid for the specific service or product giving rise to the claim, or R1000, whichever is less.

    7. Dispute Resolution

    Governing Law


    These Terms are governed by the laws of the Republic of South Africa.

    Jurisdiction


    Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of KwaZulu-Natal, South Africa.

    Alternative Dispute Resolution


    Before legal action, parties agree to attempt good faith negotiation to resolve disputes.

    Mediation


    If negotiation fails, disputes may be referred to mediation:
  • Mediator: Mutually agreed upon mediator

  • Costs: Shared equally between parties

  • Binding: Mediation outcome is binding if agreed

    8. Code of Conduct

    Expected Behaviour


    Users of the System must:
  • Respect Others: Treat all users with respect and dignity

  • No Harassment: Refrain from harassing, abusive, or discriminatory behaviour

  • Fair Play: Abide by competition rules and fair play principles

  • Professionalism: Conduct themselves professionally at all times
  • Prohibited Conduct


    The following conduct is prohibited:
  • Verbal Abuse: Insulting or threatening language

  • Discrimination: Based on race, gender, religion, or sexual orientation

  • Cheating: Manipulating results or violating competition rules

  • Fraud: Submitting false information or documentation

  • Disruption: Interfering with System operations or events
  • Consequences


    Violations may result in:
  • • Warning or temporary suspension

  • • Permanent account termination

  • • Disqualification from competitions

  • • Legal action where appropriate

    9. System Modifications

    Service Changes


    FEDSA reserves the right to:
  • Modify Features: Add, remove, or modify System features

  • Update Pricing: Change fees for services with 30 days notice

  • Update Terms: Modify these Terms at any time

  • Discontinue Services: Stop offering certain services
  • Notification of Changes


    Significant changes will be communicated via:

  • Continued Use


    Continued use of the System after changes constitutes acceptance of the new Terms.

    10. Termination

    Account Termination by User


    You may terminate your account at any time by:

  • • Calling our office during business hours
  • Account Termination by FEDSA


    FEDSA may terminate or suspend your account if:
  • Terms Violation: You violate these Terms

  • Inactivity: Account is inactive for 24 months

  • Illegal Activity: Account is used for illegal purposes

  • Safety Concerns: Your account poses security or safety risks
  • Termination Effects


    Upon termination:
  • Access Revoked: Access to the System is immediately revoked

  • Outstanding Fees: You remain liable for outstanding fees

  • Data Handling: Your data will be handled per our Privacy Policy

  • No Refund: No refund of fees for the current period

    11. Indemnification

    You agree to indemnify and hold FEDSA harmless from:

    Payment processing is handled by third parties (e.g., Paystack). FEDSA:
  • Not Liable: Not liable for payment processor errors

  • No Guarantee: Does not guarantee payment processor security

  • Separate Terms: Payment processors have their own terms

    13. General Provisions

    Entire Agreement


    These Terms constitute the entire agreement between you and FEDSA regarding the System.

    Severability


    If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.

    Waiver


    Failure to enforce any provision does not constitute a waiver of that provision.

    Assignment


    You may not assign these Terms without FEDSA's written consent. FEDSA may assign these Terms freely.

    Force Majeure


    FEDSA is not liable for delays or failures due to causes beyond its reasonable control.
